GDPR and Spanish LOPDGDD compliance

1. Data Controller

The controller responsible for the personal data collected on this website is:

  • Controller: Ático Estudio Gráfico, S.L.
  • Tax ID (CIF): B13530050
  • Address: Carretera Toledo 26, 303, 13005 Ciudad Real, Spain
  • Contact Email: info@form-it.com.es

2. Types of Data Processed and Purpose

Through our AI-powered interactive form-building platform, personal data is collected only when a respondent answers the forms published by their creators.

Purposes of processing:

  • Conversational Processing (AI): Conversationally analysing the answers entered by the respondent, by voice or keyboard, to fill in the form's fields in an interactive, guided way.
  • Session Management (Resume): Using technical identifiers to let the respondent save their progress and resume filling in a form in progress.
  • Sending Data to the Form Creator: Form-it acts solely as a data processor. The data collected is stored and made available to the form's owner, who acts as an independent controller for its subsequent commercial or administrative use.

Technical data for each response. When a form is answered, the Service records the approximate country, browser and operating system of the respondent, and the campaign tags (UTM) of the access link, so that the form owner can analyse where their responses come from.

Special fields. If the form includes a map-location field, the address and coordinates the person chooses are processed; the browser may ask for permission to use their current location and it is used to place the point only if the person grants it. If it includes signature, file or image fields, the signature image and the uploaded files are stored, served from a public address with a random name, and deleted together with the response.

Continue later and data in the link. If the person asks to receive a link to continue later, their email is used only to send that link and is not given to the form owner. A form may also receive data through its web address (prefilled or hidden fields) when whoever distributes it adds them to the link.

3. Legal Basis for Processing

The legal basis for processing your data is the explicit consent given by the user when starting and interacting with the form's assistant, as well as the legitimate interest of the form's creator in requesting the information for the purposes stated in their respective questionnaire.

4. Data Retention

Data collected through form responses is retained on our servers only for the period strictly necessary to fulfil the purpose for which it was collected, or until the form's creator (owner) deletes it from their dashboard, or until the respondent exercises their right to erasure.

5. Data Recipients

Data captured through forms will not be disclosed to third parties, except where required by law, regulatory exemption, or the express request of the form's creator (who exercises direct control over it). For the AI's conversational processing, trusted service providers may be used (sub-processors such as language-model APIs) under strict confidentiality and secure data-processing agreements. In Voice mode, the respondent's voice is sent in real time to a voice-AI provider (currently Google LLC; OpenAI, L.L.C. or another equivalent provider may also be used), as explained in section 7.

The relationship between Form-it, as processor, and each form's creator, as controller, is regulated in detail in the Data Processing Agreement, which lists the specific sub-processors used by the platform.

Mapbox, Inc. is used for maps and receives, from the participant's browser, the addresses searched and the coordinates; Stripe is used for payments and billing; and for anti-bot verification and error logging, the providers listed in the Data Processing Agreement are used.

6. User Rights

In accordance with the General Data Protection Regulation (GDPR), you have the following data-protection rights:

  • The right to access your personal data being processed.
  • The right to request rectification of inaccurate data.
  • The right to request erasure of your data when it is no longer necessary for the purposes it was collected for.
  • The right to object to processing or request its restriction.
  • The right to data portability.

To exercise any of these rights, you can contact us by sending a request by email to: info@form-it.com.es, attaching a copy of your identity document.

7. Voice Conversation and Microphone Use

Some forms offer, in addition to Classic and Chat modes, a Voice mode: the respondent talks out loud with an artificial-intelligence assistant, not a person, and the assistant fills in the form with their answers. This mode is optional: it is never the only way to respond, and the respondent can switch modes at any time.

  • Microphone permission: the browser asks for microphone access when the respondent chooses Voice mode. Without that permission the voice conversation does not start and the other modes are offered. The microphone is used only during the conversation and is released when it ends or the page is closed.
  • What is sent and to whom: audio is streamed in real time directly from the respondent's browser to a voice-AI provider (currently Google LLC; OpenAI, L.L.C. or another equivalent provider may also be used), using temporary single-use credentials. The audio does not pass through Form-it's servers. The provider processes it to hold the conversation and obtain the transcript, and may retain certain data for a limited time under its own terms (for example, to prevent abuse).
  • What Form-it keeps: Form-it does not record or keep the audio. It does keep the automatic transcript of the conversation (the text of what the respondent and the assistant said) together with the answers to the form's fields, to make them available to the form's owner, who can view it in the detail of each response. The transcript is automatic and may contain errors. It is deleted when the response it belongs to is deleted. Data the assistant proposes to save (for example, a phone number or an email) is validated on our servers and confirmed with the respondent before being saved.
  • Use of the voice: the voice is processed only to hold the conversation and fill in the form. It is not used to identify the person or to build profiles, and it is not treated as biometric data for identification purposes.
  • AI disclosure: the Voice mode screen tells the respondent, before starting, that they are speaking with an artificial-intelligence assistant and that their voice is processed by a third-party provider.

The form's owner, as data controller, decides whether to offer this mode and must inform respondents in line with their own privacy policy. The voice sub-processor's terms are listed in the Data Processing Agreement.
